1. Information We Collect
We collect information in three ways: information you give us, information collected automatically, and information we receive from third parties.
1.1 Information you provide to us
When you request an estimate, book an appointment, contact us, or otherwise interact with the Site, you may provide:
- Contact details — your name, phone number, email address, and mailing or service address.
- Vehicle information — make, model, year, color, license plate, and/or VIN, and a description of the damage or the work you want done.
- Photos and files — images of your vehicle that you upload so we can assess damage and prepare an estimate. These photos may incidentally include license plates, VINs, or other identifying details.
- Insurance information — your insurance carrier, claim or policy number, and adjuster details, if you choose to share them so we can help process a claim.
- Communications — the content of messages, emails, texts, or voicemails you send us, and your communication preferences.
- Appointment details — preferred dates, drop-off/pick-up arrangements, and similar scheduling information.
You do not have to provide this information, but we may not be able to prepare an estimate or provide service without it.
1.2 Information collected automatically
When you visit the Site, limited technical information may be collected automatically by our hosting provider to keep the Site secure and running:
- Device and log data — IP address, browser type, operating system, referring pages, pages viewed, and the dates/times of your visits.
- Approximate location — a general location derived from your IP address (not precise GPS).
We use Google Analytics 4, a web-analytics service provided by Google, to understand how visitors find and use the Site — for example, which pages are viewed and roughly where visitors come from. Google sets cookies and receives your IP address and device information as part of this. We do not use advertising or ad-retargeting tools on the Site. You can opt out of Google Analytics across all sites by installing Google’s browser add-on at https://tools.google.com/dlpage/gaoptout.
1.3 Information from third parties
We may receive information about you from insurance companies and adjusters working with you on a claim; from referral sources such as dealerships or people who refer you to us; and from review and social platforms (e.g., Google, Yelp, Facebook) if you interact with our listings there.
2. How We Use Your Information
We use the information we collect to:
- Prepare and provide repair estimates and respond to your requests and questions.
- Schedule, perform, and follow up on repair and body-shop services.
- Communicate with you by phone, email, or text about your estimate, vehicle, and service status.
- Coordinate with your insurance company and parts suppliers to complete your repair.
- Operate, maintain, secure, and improve the Site.
- Send service updates and, where permitted, occasional promotions or offers (you can opt out at any time — see Section 10).
- Detect, prevent, and address fraud, abuse, security issues, and technical problems.
- Comply with legal obligations and enforce our terms and agreements.
We do not use your personal information for automated decision-making that produces legal or similarly significant effects about you.
3. How We Share Your Information
We share personal information only as described below. We do not sell your personal information, and we do not share it for cross-context behavioral advertising.
- Service providers — companies that perform services for us and may use your information only to perform those services. These currently include Cloudflare (website hosting and content delivery), Web3Forms (delivering estimate/appointment form submissions to us by email), and Supabase (securely storing your request so our staff can follow up).
- Insurance companies, adjusters, and parts suppliers, as needed to estimate and complete your repair.
- Professional advisors, such as our accountants, lawyers, and insurers.
- Legal and safety reasons — to comply with the law or a lawful request; to protect the rights, property, or safety of Marlin Motors, our customers, or others; or to investigate fraud or security issues.
- Business transfers — in connection with a merger, acquisition, financing, or sale of assets.
4. Cookies and Tracking Technologies
We use technologies that are strictly necessary to make the Site work and keep it secure, plus Google Analytics 4, which sets analytics cookies to measure how the Site is used. We do not use advertising or ad-retargeting cookies. You can control cookies through your browser settings and can usually delete or block them; blocking some may affect how the Site works. To opt out of Google Analytics specifically, install Google’s browser add-on at https://tools.google.com/dlpage/gaoptout.
5. Text Messaging (SMS) and Phone Calls
With your consent, we may contact you by text message or phone about your estimate, appointment, or vehicle status.
- Consent — by providing your phone number and choosing text/call as a contact method (or by texting us first), you consent to receive calls and text messages from us at the number you provide. Consent to marketing texts is not a condition of any service.
- Message frequency varies based on your interactions with us, and message and data rates may apply from your carrier.
- Opt out of texts at any time by replying STOP; reply HELP for help.
- We do not share your mobile number with third parties for their own marketing.
6. Photos and Vehicle Images
Photos you upload are used to assess damage, prepare estimates, document repairs, and communicate with you and (where applicable) your insurer.
- We do not publish your photos publicly or use them in marketing (for example, before-and-after galleries) without your separate permission.
- Uploaded images may contain license plates or VINs; we treat these as part of your personal information and handle them accordingly.
- We restrict uploaded files to reasonable image types and sizes and transmit them securely to the shop.
7. Third-Party Services and Links
The Site includes third-party features and links, such as an embedded Google Map (which loads only after you choose to view it) and links to our social media and review pages on Google, Yelp, Facebook, and Instagram. These third parties have their own privacy policies, and we are not responsible for their practices. We encourage you to review the privacy policy of any third-party service you use.
8. Data Retention
We keep personal information for as long as needed to fulfill the purposes described in this Policy — for example, to provide estimates and services, maintain business and warranty records (we warranty body and paint work for as long as you own the vehicle), resolve disputes, and comply with legal, tax, and accounting requirements. When information is no longer needed, we take reasonable steps to delete or de-identify it.
9. Data Security
We use reasonable administrative, technical, and physical safeguards designed to protect your personal information — including serving the Site over HTTPS and limiting access to those who need it. However, no method of transmission or storage is completely secure, and we cannot guarantee absolute security. Please avoid sending sensitive details (such as full Social Security numbers or full payment card numbers) through the Site’s forms, email, or text.
10. Your Privacy Rights and Choices
Depending on where you live, you may have the right to access, correct, or delete the personal information we hold about you, to obtain a portable copy, and to opt out of the sale or sharing of personal information or targeted advertising. We do not sell or share your personal information or use it for targeted advertising.
You can opt out of promotional emails using the "unsubscribe" link and of texts by replying STOP; we may still send non-promotional messages about your service. To make a privacy request, contact us using the details in Section 13. We will take reasonable steps to verify your identity, respond as required by applicable law (including the California CCPA/CPRA and the Florida Digital Bill of Rights, where they apply), and we will not discriminate against you for exercising your rights.
11. Children's Privacy
The Site is intended for adults and is not directed to children under 13. We do not knowingly collect personal information from children. If you believe a child has provided us personal information, please contact us and we will delete it.
12. Changes to This Policy
We may update this Policy from time to time. When we do, we will revise the "Last updated" date above and post the new version on this page. Your continued use of the Site after an update means you accept the revised Policy.
